Assessment of Request

Engaging in the tender process exposes contractors to significant amounts of legal and commercial risk. Time, resource, and technical constraints can cause contractors to enter into the tender process without due regard for the assessment and treatment of that risk. Risk untreated at the time of tender can, and often does, cause significant and irreparable commercial damage, and is less easily managed after the award of contract.

HCA protects its clients by undertaking analysis of Request for Tender, or request for proposal documents, to determine the risk residing in those documents, especially regarding scope and contract provisions, and by determining and recommending appropriate commercial safeguards to remove or mitigate that risk.
